Terms of service

Because evadity is built on a zero-knowledge architecture, our terms are radically simple. By generating an account number and activating a plan, you represent that you are of legal age to form a binding contract and you agree to the following rules.

1. The nature of your account

You do not have a traditional identity on our platform. Your entire relationship with us is tied to a cryptographically generated 16-digit account number.

  • Account security: Your account number is your only key. We explicitly refuse to ask for an email address, username, phone number, or backup authentication method.
  • No recovery: We cannot recover lost accounts or transfer plans because we have absolutely no way to verify who you are. If you lose your 16-digit account number, your account, access tokens, and any remaining data allowances are permanently inaccessible. We will not, under any circumstances, recover or surrender an account number to anyone.

2. Acceptable use and data limits

We built evadity to act as a blind, encrypted router utilizing the Shadowsocks protocol to defeat Deep Packet Inspection (DPI).

  • Network restrictions and port 25: We enforce zero network-layer restrictions; we do not monitor your payload, and we do not block torrenting, P2P, or specific websites. However, evadity operates on third-party cloud infrastructure (Google Cloud Platform and Amazon Web Services). To prevent email spam, these providers restrict traffic on port 25 (SMTP), blocking outbound connections or throttling inbound connections until the connection stalls.
  • Resource limits and privacy sweeps: Your plan dictates your monthly data allowance and the maximum number of proxy servers you can have active simultaneously. At the end of your monthly data cycle, an automated serverless function sweeps the database and resets your usage counter to zero, permanently erasing your historical usage volume.
  • Structural abuse: You agree not to use evadity to conduct high-volume malicious activity, such as launching outbound Distributed Denial of Service (DDoS) attacks or engaging in mass port scanning.
  • Automated enforcement: While we do not monitor your traffic, our cloud providers employ automated defenses. If you abuse the network, their underlying hypervisors will flag anomalous outbound traffic and automatically null-route the IP address or terminate the server completely independent of us.
  • Application and API abuse: Our client applications are open source, and we welcome independent security audits of our code. However, you agree not to intentionally overload our APIs or engage in rapid proxy server cycling to exhaust our platform resources. We reserve the right to manually terminate any account actively attempting to exploit or degrade our backend systems.

We architecturally cannot comply with DMCA or copyright infringement notices. If a copyright holder flags a file-sharing event, the cloud provider forwards that notice to us. Because every proxy server is stripped of OS-level logging, it is impossible to cross-reference a flagged IP and timestamp with a specific 16-digit account number. The notice is a dead end.

If we receive a subpoena demanding the real-world identity behind an account number, we cannot comply because we possess no identity data to surrender. However, if you use evadity to conduct high-profile attacks, authorities may subpoena our cloud providers for connection metadata to trace your connection back to your local ISP.

4. Billing, cancellations, and lost accounts

We use Stripe to securely process all payments, utilizing external webhooks to synchronize your active plan status against a blind stripe_id.

  • Billing cycle: Plans automatically renew until canceled. You may cancel your plan at any time through your account dashboard, which will disable future billing but allow you to continue using evadity for the duration of the current billing cycle.
  • Lost accounts and blind cancellations: If you lose your account number but have an active plan, you can contact us and provide the exact transaction date and the receipt number found on your bank statement. We will use this to locate the active plan in Stripe and execute a blind cancellation of all future charges. We will refuse to disclose the associated 16-digit account number to anyone, including the cardholder.
  • Chargebacks and disputes: We ask that you contact us first to resolve any billing issues or to request a refund. If a chargeback or payment dispute is initiated through your bank or card issuer, your account and all active proxy servers will be immediately terminated.

5. Refund policy

evadity provisions raw cloud infrastructure. When you route traffic, we immediately incur non-refundable egress costs from our cloud providers. Service starts immediately, but you may contact us within 14 days of a purchase date for a refund under the following conditions:

  • Full refund: If the data usage counter for your plan or data add-on remains at exactly zero bytes, we will issue a full refund.
  • Prorated refund: If you have consumed data on your plan, your refund will be prorated. We calculate the exact percentage of the data allowance you consumed within your current monthly data cycle and deduct that prorated amount from that month's cost. For yearly plans, we will refund the remaining 11 months in full, plus the prorated amount for your first month. One-time data add-ons are immediate bulk provisions and are not eligible for prorated refunds once any data has been consumed.

Our 14-day refund window applies to your initial plan purchases, yearly plan renewals, and untouched data add-ons. Monthly plan renewals are not eligible for refunds.

Refund requests must be initiated while you still have access to your 16-digit account number so we can securely verify your exact data usage to determine your refund eligibility.

6. Service availability (Disclaimer of warranties)

evadity is provided on an "AS IS" and "AS AVAILABLE" basis. While our architecture is highly resilient to state censorship, sophisticated firewalls may deploy heuristic filters that indiscriminately drop traffic.

If your connection is interrupted or targeted by IP blocks, our architecture allows you to terminate the impacted server and deploy a fresh cloud IP. We do not guarantee uninterrupted proxy connections and are not liable for business interruptions or data loss.

7. Limitation of liability

To the maximum extent permitted by law, evadity and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. If a failure of our infrastructure causes you financial loss or business interruption, our maximum aggregate liability to you shall not exceed the total amount you paid to us in the twelve months preceding the event.

8. Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes regarding these terms will be handled exclusively in the state or federal courts located in Delaware.

9. Modifications

We may update these terms periodically. Because evadity is a zero-knowledge platform, we do not collect email addresses and cannot notify you directly when changes occur. We will simply update this page and revise the "Last updated" date at the top. Your continued use of the service after modifications are published constitutes your acceptance of the new terms.
